These General Conditions of Sale apply between:

These General Conditions of Sale apply, without restriction or reservation, to all sales concluded by LES COURTOISES to non-professional buyers wishing to acquire products offered for sale online on the Site.
These General Conditions of Sale are accessible at any time on the Site and will prevail, where applicable, over any other version or any other contradictory document.
Unless proven otherwise, the data recorded by LES COURTOISES constitutes proof of all transactions.

Article 1: object

The purpose of these General Conditions of Sale is to define the commercial relations that the Parties establish on the Internet network, resulting from the online sale of the Products offered on the Site. These conditions regulate all the steps necessary for placing the order and ensure the monitoring of this order between the Contracting Parties.
The Parties agree that their relations will be governed exclusively by this contract. If a condition were to be missing, it would be considered to be governed by the practices in force in the distance selling sector for companies with their head office in France.

Article 2. Products – Price

2.1. Products

The products offered for sale by LES COURTOISES are those appearing on the Site, on the day of its consultation by the User.

2.3. Price

Prices are indicated in euros (€) inclusive of all taxes and take into account any reduction if applicable.
The prices indicated are guaranteed within the limits of available stocks, except for significant changes in charges and except for typographical errors or omissions. The prices indicated do not take into account shipping costs which will be invoiced in addition and will be specified to the User upon final validation of their order.
LES COURTOISES reserves the right to modify their prices at any time, but the Products will be invoiced on the basis of the prices in force at the time the order is registered, subject however to the availability of said Products.
The prices mentioned on our site are accurate but errors may occur. If we discover a pricing error on a product you have ordered, we will notify you as soon as possible and give you the opportunity to cancel or confirm the order at the correct price. If we are unable to reach you, we will cancel the order automatically and you will receive a full refund. If you cancel, the order will be fully refunded.

Article 3. Registration and validation of the order

3.2. Order registration

3.3. Final validation of the order

It is specified that by making an immediate payment by bank card, as provided for in article 4 below, the User will then be automatically switched to the electronic payment server of the secure payment platform STRIPE or (hereinafter referred to as " the bank "). The bank's server is secured by S.S.L encryption. (Secure Socket Layer) in order to protect all data linked to payment methods as effectively as possible. At no time will the User's banking data pass through the LES COURTOISES computer system. The liability of LES COURTOISES is therefore released in this respect.

As soon as he validates his payment, the order is recorded and becomes irrevocable. The User becomes a Buyer. The order form will be recorded in the computer records of the company LES COURTOISES, themselves kept on a reliable and durable medium, and will be considered as proof of the contractual relations between the Parties.

3.4. Order confirmation

When payment has been made, a summary of the Buyer's order will be sent by email, upon receipt of the purchase order, to the email address indicated by him at the time of the order. This confirmation will include all the constituent elements of the contract between the Parties, as well as an estimate of the shipping date.
LES COURTOISES recommends that the Buyer keep their order confirmation email or print it. However, documents archived in the computer systems of the company LES COURTOISES will be considered as legal evidence.

Article 4. Payment

4.1. Amount of the order

The amount owed by the Buyer is indicated before validation of the order by the User, as well as on the order confirmation sent by email by LES COURTOISES to the Buyer.

5.2. Shipping

The Products are shipped to the delivery address indicated by the Buyer in their customer account. If the buyer has several delivery addresses registered in his customer account, he can select one before finalizing his order and making payment. LES COURTOISES do not deliver to post office boxes.

5.3. Delivery

Packages are generally delivered within 2 or 3 days in mainland France, Europe and outside Europe with COLISSIMO ®. If the Buyer is not present when the package is presented at the delivery address, a delivery notice will be left by the Carrier in the recipient's mailbox to inform them of this. 5.4. Lost package

If within 7 working days following the dispatch of his order, the Buyer has still not received his parcel nor a delivery notice nor precise information via the online tracking of his parcel, he must go to your nearest post office or parcel point, with the parcel tracking number available in your customer account as well as in the confirmation email sent to you when the parcel was sent.
If the Carrier finds no trace of the package, the Buyer must contact LES COURTOISES Customer Service as soon as possible (send a message to Customer Service).
Customer Service will then open an investigation with the Carrier. The Buyer will receive an email informing them that a postal survey has been opened and that response times vary between 10 and 30 days from the opening of the survey. If the package is found, it will be immediately returned to the Buyer. If the package is considered lost, LES COURTOISES will reimburse the amount of the order.

5.5. Customs duties

Any order placed on the Site and shipped outside France may be subject to possible taxes or customs duties. These costs related to delivery are the responsibility of the Buyer and are his responsibility. LES COURTOISES are not required to inform the User of the taxes or customs duties applicable to the countries of delivery. 5.6. Defective products

If, despite all the care taken by LES COURTOISES when preparing orders, one of the Products delivered turns out to be defective, the Buyer will have a period of seven (7) days from the day of delivery. to return the defective product at its own expense for exchange or refund. In order for this request to be processed as quickly as possible, any defect must be notified to LES COURTOISES Customer Service who will then issue a return authorization.
The package accompanied by the return authorization (e-mail) must be returned, with sufficient postage, to the address communicated by LES COURTOISES Customer Service (send a message to Customer Service).
Any complaint made after the seven-day period will be rejected and LES COURTOISES will be released from all liability. If the aforementioned conditions are met, LES COURTOISES will then exchange or reimburse the defective Product(s) and the shipping costs linked to the Product(s), within thirty (30) days from the date of receipt by LES COURTOISES of the package.

Article 6. Right of withdrawal and returns

If one day a product does not suit you, no problem, you have 14 clear days from receipt of the order to return it and receive a full refund as soon as possible. At the end of this period, the right of withdrawal becomes irremediably void.

The product must be properly protected, in its original packaging (box or dust bag), in perfect condition for resale. Upon receipt, LES COURTOISES will carry out a careful examination of the Product. It must obviously not have been worn – even if only once. At the time of examining the Product, if it turns out that LES COURTOISES has the slightest doubt as to whether the bag has been worn (trace, dirt, scratch, stain, friction, even minor deterioration, etc.) or that the product is damaged or soiled, (even barely,) LES COURTOISES will not make any refund or exchange, even accompanied by any possible accessories, instructions for use and documentation. It must also be accompanied by the sales invoice so as to allow the identification of the Customer (order number, last name, first name, address).

As part of this right of withdrawal, and for returned Products which prove to be incomplete, damaged (friction, stain, scratch, even minor), soiled or unfit for resale, LES COURTOISES will refuse to reimburse the returned products. , exchange them, or apply a discount to the reimbursement amount.
Any package returned to the address communicated by LES COURTOISES Customer Service and not including any element allowing the Buyer to be identified, in particular the return number, cannot under any circumstances be refunded. No complaints from the Buyer will be accepted.
If the aforementioned conditions are met, LES COURTOISES will reimburse the Buyer, within fourteen (14) days maximum from the date of receipt by LES COURTOISES of the package.
The costs and risks associated with reshipment are the responsibility of the Buyer. Therefore, it is up to him to keep all evidence of this return. LES COURTOISES therefore recommends that the Buyer return the Products by tracked registered delivery or Colissimo. If the product is lost by the carrier during this shipment, the Buyer will be solely responsible and cannot be reimbursed by LES COURTOISES.
If your order was sent outside the European Union, please mention that it is a return for non-compliance on the delivery note. Sales and customs clearance taxes will be your responsibility and will be deducted from your refund.
In order to provide you with an incomparable shopping experience, we offer you a flexible returns policy. However, we reserve the right to refuse orders if we notice too frequent returns.
However, products purchased on the site www.lescourtoises.fr cannot be exchanged.

Article 7. Legal guarantees

In accordance with the legal provisions in force, all Products are subject to a guarantee of conformity (Articles L.211-4 et seq. of the Consumer Code) and to a guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

The action resulting from the lack of conformity is prescribed two years from the delivery of the goods.

9.2. Cookies

The only cookies that LES COURTOISES create are those of the session which will be deleted when disconnecting from the site.

Article 10. Liability

The liability of LES COURTOISES is strictly limited to the amount of the Buyer’s order.
The involvement of LES COURTOISES cannot be blamed for all the inconveniences or damages inherent in the use of a computer, a computer network or the Internet network.
In particular, LES COURTOISES cannot under any circumstances be held responsible for a break in service, an external intrusion or the presence of a computer virus.
For all stages of access to the Site, in particular consultation, form filling, placing an order, payment as well as any other service available on the Site, LES COURTOISES only has an obligation of means.
During shipping, it is up to the User to check with local authorities the specifics regarding taxes, declarations, prohibitions, possibilities of import or use of the Products ordered. LES COURTOISES cannot be held liable in the event of non-compliance with the legislation of the country where the Products will be delivered.

Article 11. Duration

These conditions apply throughout the duration of the online posting of the Products offered by LES COURTOISES

Article 12. Miscellaneous stipulations

12.1. Partial invalidity

If one or more stipulations of these General Conditions of Sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their strength and scope.

12.2. Entire contract

These General Conditions of Sale and the order summary sent to the Buyer form a contractual whole and constitute the entirety of the contractual relations between the Parties. In the event of a contradiction between these documents, the General Conditions of Sale will prevail.

12.3. Force majeure

LES COURTOISES will not be responsible for the total or partial non-performance of their obligations under this contract, if this non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flooding, fire.
Events meeting the criteria set by the case law of the Court of Cassation will be considered as force majeure.
In the presence of an event constituting force majeure, LES COURTOISES will notify the User/Buyer within five (5) working days following the occurrence or threat of this event.
The Parties agree that they must consult as soon as possible in order to jointly determine the terms of execution of the order during the duration of the force majeure event.
Beyond a period of one (1) month of interruption due to force majeure, LES COURTOISES may not honor the order, it being its responsibility to reimburse the Buyer if necessary, within thirty (30) days.

Article 13. Applicable law – Competent courts

These conditions are subject to French law.
Jurisdiction in the event of a dispute, and in the absence of an amicable agreement between the Parties, is given to the competent Courts within the jurisdiction of the Paris Court of Appeal.
